GENERAL TERMS AND CONDITIONS

Corporate Name: Inversiones Turísticas Peru Andean Views S.R.L.
In all commercial communications, quotations, promotional material, and customer service interactions, the company operates under the trade name Peru Andean Views. For legal, contractual, tax, and administrative purposes, the valid corporate name is Inversiones Turísticas Peru Andean Views S.R.L.
- Introduction
Inversiones Turísticas Peru Andean Views S.R.L., commercially operating under the brand Peru Andean Views, hereby makes these General Terms and Conditions available to the client. These terms expressly, clearly, and bindingly govern the contractual relationship between the company and the client.
This document is mandatory and constitutes a legally valid agreement. By contracting, reserving, or using any of the tourism services offered by Peru Andean Views, the client declares that they have read, understood, and fully accepted these Terms and Conditions, expressly waiving any interpretation other than that established herein.
These conditions apply to all vacation programs, tourist packages, tours, and activities organized directly by the company. Services provided by third parties—such as airlines, railway companies, the Consettur transportation service (Aguas Calientes – Machu Picchu bus), hotels, external operators, and entrance tickets to tourist attractions included in the itinerary—are governed by their own terms and conditions, which the client expressly accepts.
- Client’s Legal Capacity
By contracting our services, the client declares and guarantees that:
- They are of legal age.
- They have full legal capacity to enter into contracts.
- The information provided is true, accurate, current, and complete.
- Reservations and Service Confirmation
To secure a reservation, Peru Andean Views requires the following payment conditions:
- a) Predefined and Customized Vacation Programs
An initial payment equivalent to 40% of the total program value is required. Once this advance payment is received, the company will proceed with the management and confirmation of services, and the reservation will be considered confirmed.
The remaining balance (60%) must be paid within the period indicated by the travel advisor or upon arrival in Peru, as agreed.
- b) Individual Tours (One-Day Tours)
For one-day tours, full payment in advance is required as an essential condition to guarantee service availability.
The company reserves the right to reject or modify a reservation in case of non-compliance with payment deadlines or conditions.
- Client’s Personal Data
The client must provide complete and accurate personal information necessary for proper travel organization, including but not limited to:
- Full name
- National ID or passport number (with a minimum validity of six (6) months beyond the end of the stay in Peru)
- Copy of the identification document
- Date of birth
- Nationality
- Flight information
- Contact phone number
The client is solely responsible for the accuracy of the information provided. Peru Andean Views shall not be liable for errors resulting from incorrect or incomplete information.
- Prices, Taxes, and Surcharges
Amounts indicated in quotations sent to domestic tourists do not include the General Sales Tax (IGV). This tax will be added to the total contracted service amount in accordance with current regulations.
Foreign tourists are exempt from IGV pursuant to Legislative Decree No. 919.
Promotional rates do not apply on public holidays or festive dates and may increase by up to 10%.
Any modification not initially contemplated in the reservation may generate additional charges.
- Changes and Modifications
The client may request changes to their reservation, subject to availability, penalties, and administrative costs:
- Changes requested more than 60 days in advance: subject to evaluation, no administrative penalty.
- Changes requested less than 60 days in advance: may incur penalties of up to 50% of the service value.
- Cancellations by the Client
Cancellations must be requested in writing to the company’s official email address.
Cancellation deadlines:
- 60 days prior: refund of 50% of the amount paid, less administrative expenses and services already acquired.
- 30 days prior: refund of 25% of the amount paid, less administrative expenses and services already acquired.
- 15 days or less: no refund applies.
For one-day tours, cancellations may be made up to 48 hours prior to the service.
For tours that include Machu Picchu or other high-demand services, refunds will be subject to special evaluation due to the non-refundable nature of certain services.
- Cancellations by the Company
Peru Andean Views reserves the right to cancel or modify a service due to force majeure or external factors beyond its control, such as weather conditions, social unrest, government regulations, or other unforeseen events. In such cases, the company will coordinate with the client to offer the best possible alternative.
- Rescheduling
Rescheduling requests may be submitted up to 48 hours before the start of the trip and will be subject to:
- Availability
- Fare differences
- Penalties and administrative costs
- Claims
Any claim must be communicated immediately during the provision of the service. Failure to do so entitles the company to decline subsequent liability.
The client may request the Complaints Book within the timeframes established by Peruvian regulations.
- Client Responsibility
The client agrees to comply with the rules, instructions, and decisions adopted by the staff, guides, coordinators, and representatives of Peru Andean Views during the execution of contracted services.
The company reserves the right to partially or fully exclude the client from a tourism service, without any right to refund, when, at the company’s reasonable discretion, the client’s conduct, physical or mental health condition, or non-compliance with established rules endangers their own safety, that of other passengers, or the proper execution of the service.
The client is solely responsible for carrying valid and current documentation, including passport, visas, migration permits, and vaccination certificates where applicable. Failure to meet these requirements releases the company from any liability for the inability to provide the service.
- Assumption of Risk and Health
The client declares that they are in adequate physical condition to participate in the contracted activities and assumes the inherent risks of travel and tourism activities, especially adventure activities.
Travel insurance is strongly recommended. In the absence of such insurance, the company disclaims liability for accidents or medical emergencies.
- Flights and Delays
Peru Andean Views is not responsible for flight delays, cancellations, or rescheduling caused by external factors. However, the company will provide assistance in reorganizing the itinerary whenever possible.
- Children Policy
Unless otherwise stated:
- Up to 6 years old: considered children
- From 7 to 14 years and 11 months: considered students
- From 15 years old: considered adults
- Last-Minute Reservations
Reservations made within 30 days prior to the trip will be subject to different rates due to limited availability and additional operational costs.
- Acceptance and Jurisdiction
The client expressly declares that they have read, understood, and accepted these General Terms and Conditions, acknowledging that they constitute a legally binding agreement.
Acceptance of these Terms and Conditions occurs automatically upon making any payment, advance, or reservation confirmation.
Any dispute, claim, or legal action arising from the interpretation, execution, or fulfillment of this agreement shall be governed by the laws of the Republic of Peru and submitted to the jurisdiction of the competent courts within Peruvian territory. The client expressly waives any other jurisdiction that may apply.
REGULATED TOURISM SERVICES: MACHU PICCHU AND INCA TRAIL
Tourism services related to Machu Picchu and the Inca Trail, including but not limited to entrance tickets, official permits, daily quotas, authorized circuits, access dates, railway services, Consettur transportation (Aguas Calientes – Machu Picchu bus), guiding services, porters, campsites, meals, logistical equipment, and other complementary services, are subject to strict regulations, limited availability, and provisions established by the Ministry of Culture, SERNANP, and other competent authorities, as well as authorized external providers.
The client acknowledges and accepts that entrance tickets to Machu Picchu and permits for the Inca Trail are personal, nominative, non-transferable, non-assignable, and by nature generally non-refundable and non-modifiable once issued, in accordance with current regulations.
Any change, rescheduling, or cancellation—whether attributable to the client or imposed by competent authorities—will be subject to the restrictions and penalties established by such entities and may result in the total or partial loss of the amounts paid, without giving rise to any right to a refund from Peru Andean Views.
Peru Andean Views acts solely as an intermediary in the management and reservation of these regulated services and therefore assumes no responsibility for temporary closures, circuit modifications, quota reductions, forced rescheduling, operational changes, adverse weather conditions, social conflicts, government regulations, or force majeure events that prevent the partial or total execution of the service.
Specifically for the Inca Trail, the client acknowledges that failure to meet minimum physical requirements, comply with trail regulations, follow the authorized guide’s instructions, or adhere to competent authorities’ provisions may result in immediate removal from the route, without any right to a refund, in order to safeguard group safety and the conservation of the protected area.
The client also accepts that the company does not guarantee the availability of Machu Picchu or Inca Trail permits until such permits have been officially confirmed by the competent authorities, even if partial or full payment has been made.
AUTHORIZATION FOR THE USE OF IMAGE AND AUDIOVISUAL MATERIAL
The client expressly, freely, voluntarily, and gratuitously authorizes Inversiones Turísticas Peru Andean Views S.R.L., commercially operating as Peru Andean Views, to capture, reproduce, use, distribute, and publish their image, voice, and/or participation—individually or collectively—in photographs, videos, or any other audiovisual material generated during the provision of the contracted tourism services.
This authorization is granted exclusively for promotional, advertising, informational, and commercial purposes and may be used on social media, the company’s website, digital material, commercial presentations, and other dissemination media, without territorial or time limitation.
The client declares that this authorization does not give rise to any right to financial compensation and expressly waives any future claims related to the use of such material, provided that such use does not infringe upon their honor, dignity, or reputation.
If the client does not wish to authorize the use of their image, they must notify the company in writing prior to the start of the tourism service.
